Alaska: Summary
Decriminalized? – Yes. 1 oz. or less in your residence carries no penalty. If it is outside of your residence, it is a misdemeanor, punishable by 90 days in jail and a $1,000 fine. Possession of less than 25 plants in your home is also legal, per Ravin v. Alaska.
Possession of 1 to 4 oz. is a misdemeanor, punishable by 90 days in jail and a $1,000 fine.
Possession of more than 4 oz. or 25 or more plants is a felony, punishable by 5 years in prison and a $50,000 fine.
Possession of any amount within 500 feet of a school or community center is a felony, punishable by 5 years in prison and a $50,000 fine. However, if it is inside of a residence, it can be within 500 feet of a school.
Distributing less than 1 oz is a misdemeanor, punishable by 1 year in jail and a $5,000 fine.
Distributing 1 oz or more is a felony, punishable by 5 years in prison and a $50,000 fine.
Maintaining a place where marijuana is being distributed is a felony, punishable by 5 years in prison and a $50,000 fine.
Medical Program? – Yes.
For each patient (including the caregiver, and/or grower) there is a limit of 3 mature plants (larger than 12 inches tall, or in diameter, or showing signs of flowering), 3 immature plants (less than 12 inches tall, or in diameter, showing no signs of flowering), and 1 dried ounce at any given time.
Note – You might wonder why there needs to be a medical program, if you can have up to 24 plants and an ounce at your residence. Medical patients have the added protection of being able to travel with their medicine in a closed container throughout the state.
Current debilitating ailments include; malignant neoplasm (cancer), glaucoma, HIV or AIDS, Alzheimer’s Disease, cachexia, severe pain, seizures – including but not limited to seizures caused by epilepsy, and persistent muscle spasms, including but not limited to spasms caused by multiple sclerosis.
