After Secretary Jaeger approves the initiative, supporters will begin gathering signatures. To qualify for the general election, the medical [Continue Reading]

Tax Court Rules Dispensaries Can Deduct Expenses Despite 280E

Dispensaries May Deduct Some Expenses O.K., I admit the ruling is not new, but the tax court’s message is an important one as hundreds of dispensaries will open across the country this year–be very careful about accounting for expenses. Our tax code is a jungle rife with danger even for the nimblest of tax attorneys. Dispensaries have learned first hand, the pitfalls of overlooking obscure tax laws like Section 280E, which prohibits anyone from claiming tax deductions for expenses related to the sale of a controlled substance. The inability to [Continue Reading]

It’s a great moment for patients, activists, and entrepreneurs alike. Arizona finally has the chance to prove that its tightly regulated dispensary system will stand up to federal muster. Republican Led House Votes to Continue Medical Marijuana Raids

Republicans Keep Up Attack On Cannabis   Yesterday, the U.S. House of Representatives had the chance to end federal raids on the medical marijuana industry. Instead, a Republican led House voted down an amendment, 262-163, to the FY 2013 Commerce, Justice, State Appropriations bill that would have defunded efforts to crack down on medical marijuana in states where it’s legal. Over 70% of Americans support legalizing medical marijuana at the national level, yet 84% of Republican representatives voted to continue arresting, and prosecuting medical marijuana patients and caregivers in states [Continue Reading]

Romney Fires Back: Marijuana Is A Gateway Drug

Romney Fires Back: Marijuana Is A Gateway Drug On Wednesday, Mitt Romney lashed out at a reporter in Colorado for daring to mention marijuana in his stately presence. When asked, “Should marijuana be legal for medical use and taxed? ” Million dollar Mitt replied, “Aren’t there issues of significance that you’d like to talk about…the economy…the growth of jobs…the need to put people back to work…the challenges of Iran?” But, Romney decided to take his marijuana assault a step further and announce his official stance on marijuana, “I think marijuana [Continue Reading]

White House Admits Marijuana Is Not A Gateway Drug

White House Admits Marijuana Is Not A Gateway Drug It’s been tough to keep up with the stream of misinformed statements from Obama on marijuana lately. Back in April, I reported on Obama’s 2012 Drug Control Strategy, and its implications for the marijuana movement. Later that month, Obama clarified his stance on marijuana in Rolling Stone, claiming he lacks the power to direct the Department of Justice to ignore the Controlled Substance Act. After tossing sand in our collective eyes, it seemed Obama had spoken his final word on cannabis. [Continue Reading]

How Will The Proposed Connecticut Medical Marijuana Program Operate?

The Connecticut Senate passed the Palliative Use of Marijuana Act 21 to 13, after a nearly 10-hour debate. Gov. Dannel P. Malloy is expected to sign the bill, which would take effect Oct. 1, 2012. Provisions on registering patients, caregivers, pharmacies and producers and on establishing a Board of Physicians would be effective as soon as the Governor signs the bill. Under the bill, the Department of Consumer Protection is charged with administering the medical marijuana program, including a registry for patients and their caregivers. First, a physician must certify [Continue Reading]

Fake Drug Checkpoints Are Becoming More Devious

Back in March, Johnny Green reported encountering a bogus drug checkpoint while journeying through Nevada along Interstate 80 with Ninjasmoker. For those of you, like me, who had never heard of a fake drug checkpoint, it’s shockingly lowbrow, even by drug cop standards. Here’s how the scam works: police set up signs along the roadway announcing, “Drug Checkpoint Ahead.” But, since the Supreme Court ruled drug checkpoints are unconstitutional in City of Indianapolis v. Edmond (2000), cops can’t actually do that to you. Instead, they set the signs up just [Continue Reading]

Will Your Medical Marijuana Referral Help If You Are Busted Abroad?

Harvard Professor Arrested Smuggling Marijuana Into Bermuda I reported yesterday that an elementary school teacher in Florida was arrested after police discovered a grow-op in her garage. She is facing three felonies and two misdemeanors. In stark contrast, a Harvard professor, Mey Akashah, was popped with six grams of marijuana in her underoos. She had arrived on a flight from Boston to visit her husband in Bermuda, when a drug dog sniffed out her stash. Facing a maximum penalty of ten years, she did what any well-educated, articulate person would [Continue Reading]

'Stellar' Florida Teacher May Lose License Over Marijuana

It’s another case of our government destroying the life of a good citizen over cannabis–this time an elementary school teacher. Diedra Hanna, and her husband Paul were arrested on Sunday after police discovered a grow-op in their garage. Local police claim to have started snooping around after smelling marijuana coming from the home. Deputies next claim they saw smoke coming from the residence. After calling in Charlotte County Fire and EMS, police entered the residence to investigate. Deputies did not reveal why they were snooping around the Hanna residence in [Continue Reading]
