Canna Care Supports Suit Against San Bernardino County Medical Marijuana Ordinance

Medical Marijuana SignCanna Care, one of the leading advocates for the rights of medical marijuana patients, has lent its support to the lawsuit filed by Crusaders for Patients’ Rights against the San Bernardino County Board of Supervisors for their recent adoption of Ordinance 4140.The case is filed with San Bernardino County Superior Court Case No. CIVDS 1105492.

This new ordinance puts restrictions on the rights to cultivate medical marijuana outdoors and the rights to establish safe and reputable medical cannabis dispensing collectives within the county.

The suit will be heard on June 27 at 8:30 am in Department S32 at 303 West Third Street in downtown San Bernardino.

“We are requesting the judge issue an alternative writ ordering the county not to enforce the ordinance,” said Lanette Davies, founder of Canna Care. “Both Canna Care and Crusaders for Patients’ Rights are organizations committed to educating medical cannabis patients of their rights and also to stand up and fight for those rights.”

San Bernardino County Superior Court Case No. CIVDS 1105492 contends that the San Bernardino Board of Supervisors has violated many elements of the law by adopting Ordinance 4140, including the California Environmental Quality Act (CEQA), the public’s right to free speech because of the restrictions placed on public comments during the ordinance hearing and patient and caregivers rights of freedom of association when three or more patients gather together.

canna careThe lawsuit further contends that the county has violated the Ralph M. Brown Act, because of its restrictions on speech during hearings, the Compassionate Use Act (Prop. 215), the Medical Marijuana Program Act and the 2008 Attorney General’s Guidelines for the Nondiversion of Medical Marijuana.

According to the lawsuit, Ordinance 4140 also violates the county’s own General Plan because it takes away the rights of medical marijuana patients to receive equal access to health care facilities and will contribute to higher greenhouse gas emission.
