Decriminalized? — No.
Possession of less than 1 oz is a misdemeanor, punishable by 30 days in jail and a $1,000 fine.
Possession of 1 oz to 1lb is a misdemeanor, punishable by 1 year in jail and a $2,000 fine.
Possession of 1-2lbs is a felony, punishable by 5 years in prison and a $10,000 fine.
Possession of 2-25lbs is a felony, punishable by 10 years in prison and a $25,000 fine.
Possession of 25lbs or more is a felony, punishable by 25 years in prison and a $50,000 fine.
For first time offenders in the possession category, diversion is possible and after completion, all charges are stricken from the offender’s record.
Cultivation of less than 24 plants is a crime, however Hawaii considers this amount to be a ‘low priority’ issue for law enforcement, and there is no funding to eradicate marijuana in this category. It is ‘informally legal.’
Cultivation of 25-50 plants is a felony, punishable by 5 years in prison and a $10,000 fine.
Cultivation of 50 to 100 plants is a felony, punishable by 10 years in prison and a $25,000 fine.
Cultivation of 100 plants or more is a felony, punishable by 20 years in prison and a $50,000 fine.
Distributing less than 1 oz is a misdemeanor, punishable by 1 year in jail and a $2,000 fine.
Distributing 1 oz to 1lb is a felony, punishable by 5 years in prison and a $10,000 fine.
Distributing 1-5lbs is a felony, punishable by 10 years in prison and a $25,000 fine.
Distributing 5lbs or more is a felony, punishable by 20 years in prison and a $50,000 fine.
Any amount of marijuana discovered in a vehicle results in all the occupants of the vehicle being charged with possession, unless it was ‘on the person’ of one of the occupants.
Medical Program? — Yes.
For each patient (including the caregiver, and/or grower) there is a limit of 3 mature plants (larger than 12 inches tall, or in diameter, or showing signs of flowering), 4 immature plants (less than 12 inches tall, or in diameter, showing no signs of flowering), and 1 dried ounce at any given time. We understand that you can informally grow up to 24 plants, but there is still incentive to get a medical card so you know you are protected no matter what!
Current debilitating ailments include; malignant neoplasm (cancer), glaucoma, HIV or AIDS, cachexia, severe pain, severe nausea, seizures — including but not limited to seizures caused by epilepsy, and persistent muscle spasms, including but not limited to spasms caused by multiple sclerosis or Crohn’s disease.
