Michigan State Police Forensic Crime Lab Marijuana Scandal

The Law Firm of Michael Komorn has learned that the Michigan State Police (MSP) Forensic Science Division crime labs have falsified lab reports on marijuana, statewide. The new MSP crime lab policy allows prosecutors to charge cannabis users with felonies they didn’t commit.

The discovery stems from a client Komorn represents pro bono in Ottawa County, Max Lorincz, who is facing two years in jail. The state has also removed his six-year-old son from the home, and placed him in a foster home due to the charges.

“The extensive emails and documents we received through the Freedom of Information Act show the prosecution are relying on the lab to report these substances so that they can escalate these crimes from misdemeanors to felonies,” said Komorn.

His client was first charged with possession of marijuana, a misdemeanor in Michigan. When he would not plead guilty–because he is a registered medical marijuana patient and has immunity for the tiny quantity he possessed–the prosecutor withdrew the charge and recharged him with synthetic THC.

A hearing is set for Thursday November 5. Komorn Law has filed a brief to dismiss all charges against the client.

The policy change began in 2013 and was prompted by Mr. Ken Stecker of the Attorney General’s Office. Stecker also serves as the Traffic Safety Resources Officer for the Prosecuting Attorneys Association of Michigan. He instructed the Lab that it could report marijuana edibles and oils as Schedule 1 synthetic THC, a felony. This was counter to both law and science as plant based edibles and oils are categorized as marihuana under Michigan law and their possession punished as a misdemeanor.

These revelations come at a time where the AG’s crusade against marijuana patients has clogged the crime lab such that 40% of its daily workload is marijuana. It took the lab five years to clear a backlog of rape kits during the same timeframe. “Maybe legalization will help us out,” said Director Michaud of the Forensic Science Division recently to the Wayne County Criminal Advocacy Program.

In other words, if legalize marijuana, we’d have the resources to go after rapists in a timely manner. Currently, Michigan police only make arrests in 15% of reported rape.

The news of the statewide lab scandal comes on the heels of a report that statewide marijuana arrests are on the rise. Between 2008, the year Michigan passed the Medical Marijuana Act, and 2014, arrests for marijuana possession or use went up 17 percent statewide, while arrests for all crimes dropped by 15 percent.

We passed a law in 2008 to legalize mmj and the local an d State police continuously bend and manipulate the law to continue busting as many people as they can. They’ve ramped up arrests recently I feel due to the fact they know full legalization is coming. People of Michigan, get out and sign the MIlegalize petition before Dec. 20th.

    Prohibition is and always has been corrupting to law enforcement at all levels. This is an egregious example. It appears that the state attorney general on down have been corrupted. This is one of the many reasons prohibition must end, and all officials responsible should face prosecution.

    The msp has a long history of ignoring or manipulating the mmma laws in there favor.arresting and prosecuting patients and caregivers.that’s one of the reasons they will be inspecting stalking and harassing all those that are awarded a new mmj license from the state under law.

    BHO isn’t synthetic, it is a concentrated extract derived from plant material. Marinol, the FDA/DEA approved synthetic analogue of the “primary intoxicant” in Cannabis, D9THC, a Schedule 3 drug (doc can write for 5 refills) is a 100% THC product that has been on the market since 1985. Why couldn’t the lab run a GC/MS? I thought that was used to determine if a legit Marinol prescription holder wasn’t augmenting their “diet” with some of that Devil Weed.
    Anyway, that this poor soul is being abused (only “abuse” going on in this confused tale) for a substance (even if “synthetic”) so “dangerous” that Marinol was moved from Schedule 2 (meth & cocaine) down to Schedule 3, in `09. The patient insert only instructs the patient to understand and accommodate for the “effects” of the medication before driving or operating machinery “under the influence” (hey, good enough for the FDA/DEA, yes?). Having been on the market for 30 years, one would think that there’d have been at least a few “horrors” to “report” about Marinol “abusers” out wrecking the world but, kind of like that big Zero on the CDC’s website listing fatalities from the use of Cannabis, alone – we’ll all keep waiting, and waiting, for some to appear – and this poor gentleman will have tax dollars heaped on him by the prosecutor in the form of a stay in ClubMI, where he can wait, as well, in pain, for some form of sanity to prevail.

    All prisoners should be immediately released. All pending charges dismissed. The DA and AG represent the people not personal agendas. Ken and Bill should be removed from office immediately. The state is unfit to regulate marijuana. The industry should become self regulating as is the case with pharmacies.
