New Michigan Marijuana Rules Being Debated Today

safer michigan marijuanaA proposed set of rules altering the nature of the Michigan Medical Marihuana Program (MMMP) will be considered by a Joint Committee today in Lansing.

The rules met stiff resistance from medical marijuana community members during a hearing on the proposed changes earlier this year. Members of Americans for Safe Access- Michigan, Cannabis Patients United, Michigan Moms United, The Michigan Cannabis Cancer Project, The Human Solution and others raised concerns regarding the proposed fee changes- and a first-in-the-nation all electronic registration process.

Current fees to enroll in the MMMP are $100 for two years and $25 for two years for people receiving federal assistance under the SSI program. The proposal would change the fee to $65 for two years for everyone, eliminating the discount for those financially disadvantaged ill and injured Michigan residents.

Also proposed: eliminating all paper records and creating an all-electronic database. All supporting documents- driver’s license, medical records- would have to be scanned into a computer and then transferred to the Michigan Department of Licensing and Regulatory Affairs (LARA), the branch of government charged with the administration of the MMMP. Currently those records are photocopied and sent in via traditional mail delivery.

Activists complained that the most rural and most impoverished of the MMMP participants would find this standard a hardship. Others pointed out that LARA and their predecessor in controlling the MMMP, the Department of Community Health, had never competently managed to administer the issuance of cards and the conducting of background checks while using paper records. To entrust a totally new system to the people that couldn’t manage a paper records system that the state has been using for years seemed overly optimistic to the hearing participants.

    Sad but true, the fee and being on SSI doesn’t even matter. I have been on SSI for years and years and michigan denied me over 5x this year to accept the reduced fee. I had to pay the 100$ out anyways after sending in 5 applications. At least the 65$ wouldnt be a huge increase from the 25.

    I’ve been involved with the mmmp for a while now. I do support the idea and we can make it cheaper for those who truly need it! I think it’s a shift in the right direction but for the mean time they will need to still be able accept mail ins for people in the UP. But its not the worst changes proposed. It’s intent is genuine.

    Almost every other day, I hear about some huge company that has been the victim of yet another hacker attack. So, with an all-electronic record system, is LARA willing to guarantee that patients’ medical records will be secure? Will these electronic records be kept on site or in the Cloud? Is LARA prepared to be sued if (and when) a leak happens?

    The ACA is pretty much forcing doctors and insurance companies to switch all of our medical records into a digital format, and while HIPAA is supposed to protect patients, the U.S. as a whole does not have sufficient protections in place for electronic records. (And I’m guessing that Michigan is receiving federal funds to move medical records from paper to computer.)

    Oddly enough, scammers and hackers make a lot more money from our medical information than our credit card information.

    My God do I ever have to get with the people in the industry. You aren’t getting any astro-glide before they stick it to you. I am forming the International Cannabis and Hemp Association, this will put struggling farmers push right behind us toward success. Some farmers in Iowa do not think they will be in business next year; industrial hemp is one of the most difficult plants to kill and weather won’t do it!!! Iowa has bio-mass fuel plants sitting empty for years!! These are just waiting to be filled with industrial hemp.     Being from Michigan I can and will say this. What a waste of tax payer money. How about some real changes Michigan, how about job protection for medical marijuana patients. There is no protection. How about edibles? How about we just get rid of the political bullshit and I’ll managed programs.
