How To Get A Medical Marijuana Card In Oregon

Oregon marijuanaThe Oregon Medical Marijuana Act protects medical marijuana users who comply with its requirements from state criminal prosecution for production, possession or delivery of a controlled substance.

Any Oregon resident with a current diagnosis of a qualifying debilitating medical condition from an Oregon licensed doctor of medicine (MD) or doctor of osteopathy (DO), and a statement from that doctor that says “marijuana may mitigate the symptoms or effects of the person’s debilitating medical condition.”

Oregon Medical Marijuana Act: Qualifying medical conditions

  • Alzheimer’s Agitation
  • Cancer
  • Glaucoma
  • HIV/AIDS
  • Cachexia (wasting syndrome)
  • Severe Pain
  • Severe Nausea
  • Seizures, not limited to Epilepsy; or
  • Persistent Muscle Spasms, not limited to Multiple Sclerosis

If the patient is under eighteen (18) years of age, the custodial parent or the legal guardian with authority to make medical decisions for the minor must give written, notarized approval and must agree to serve as the designated primary caregiver, and must agree to control the acquisition of marijuana and the minor’s dosage of frequency of use.

The Oregon Medical Marijuana Program (OMMP) Application Instructions are designed to help you to fill in the application forms required for registration with the program. Your doctor, who must be a Medical Doctor (MD) or Doctor of Osteopathy (DO) licensed to practice medicine in Oregon, will also need to complete and sign the Attending Physicians Statement. You must have an established patient/physician relationship with your attending physician. Naturopaths, chiropractors, and nurse practitioners cannot sign the documentation.

medical signAs an alternative to the Attending Physician’s Statement, you may submit signed, dated, valid, written documentation from your physician. This documentation can be in the form of a signed and dated copy of your medical records or a signed and dated letter and must state:

  • You are his or her patient
  • You have been diagnosed with a debilitating medical condition covered by the Oregon Medical Marijuana Act
  • The medical use of marijuana may mitigate the symptoms or effects of your condition
  • This documentation must also be within 90 days of the date of your new application or current card expiration

Oregon Medical Marijuana Act: Designated Primary Caregiver

  • You may choose to nominate somebody as your Designated Primary Caregiver; if you do nominate somebody you must include that person’s name and address on your medical marijuana card application form
  • The caregiver will also have to provide a copy of his or her current Oregon photo ID, Only one person may be designated as your primary caregiver
  • The person you nominate must be over the age of 18 years but having a primary caregiver is not compulsory unless you are under the age of 18 years
  • If you remove your grower, it is your responsibility to tell the grower that they are no longer protected under the OMMP

Oregon Medical Marijuana Act: Person Responsible for a Grow Site and Marijuana Grow Site Address

  • Person responsible for the grow site will be subject to a criminal history check for felony convictions
  • You must list the name, date of birth and mailing address of the person responsible for the marijuana grow site. That person must also provide a copy of his or her current Oregon photo ID
  • You must list the physical address of where your marijuana is to be produced
  • You may list only one (1) grow site; a PO Box is not acceptable for a grow site address
  • A person responsible for a grow site may be someone other than you or your caregiver
  • If you remove your grower, it is your responsibility to tell the grower that they are no longer protected under the OMMP

Oregon Medical Marijuana Act: Registration Fees

  • The fee for a NEW application is $100 or $20 if you are on the Oregon Health Plan (OHP) or if you are receiving monthly Supplemental Security Income (SSI) benefits or if you are receiving monthly Food Stamp benefits
  • The fee for a RENEWAL application is $100 or $20 if you are on the Oregon Health Plan (OHP) or if you are receiving monthly Supplemental Security Income (SSI) benefits or if you are receiving monthly Food Stamp benefits
  • See the back page of the application forms and OAR 333-008-0020 for OHP or SSI eligibility requirements
  • Please make your check or money order out to “OMMP” or “DHS/State of Oregon”
  • Do not send cash in the mail. Debit or Credit cards are not accepted
