Marijuana Barred From Evidence Because Of Illegal GPS

A federal judge has ruled that law enforcement illegally placed a GPS tracking device on a Kentucky man’s car, and has barred prosecutors from using 150 pounds of marijuana discovered in a subsequent search of the vehicle.

The Drug Enforcement Administration (DEA) and Kentucky State Police found the cannabis in a car belonging to 49-year-old Robert Dale Lee near Lexington in September 2011 because they used the GPS tracking device to follow him without a warrant authorizing it, concluded U.S. District Judge Amul R. Thapar, reports Brett Barrouquere of The Associated Press.

Lee is charged with conspiracy to distribute marijuana, but it looks like the case against him just took a huge hit now that there’s no weed.

The U.S. Supreme Court in unanimous decision in January struck down the police use of GPS devices without search warrants. That decision — in what was likely the biggest Fourth Amendment case of the computer age — rejected the Obama Administration’s position that American citizens have no right to privacy in their public movements.

Because Lee’s case predated that decision, the outcome remained in doubt until Judge Thapar’s decision.

  1. How sad…a man is using a natural product which American citizens want while a few can’t sleep at night because they don’t like it. Just legalize it and tax and remove the black market. Pot doesn’t kill, hurt, maim, or damage unlike alcohol. Pot makes you eat Fruity Pebbles and watch cartoons. Alcohol makes you drive home killing 10 or 12 people on the way home after you get home if you do get home, you kick your dog, and beat your wife and kids maybe kill them too. I have smoked weed 40 years I am 52 now I have smoked it from about the time I was 12 years old. I could get it easer that I could alcohol. If you think that keeping weed illegal is keeping it out of kids hands you are so wrong the last time I went to get my month worth of weed there was about 3 or 4 kids there from the age of 13 to 15 years old buying some too. I could not say anything for I get along with my dealer and he does not try to rip me off. I don’t want to go around looking for another dealer. I don’t care how many kids he sells to as long as I can get it myself. If weed was legal we could control it like alcohol and it would not be so easy for kids to get it and take it out of the black market like it is now. obama will not be getting my vote because marijuana is not legal for everone to use any way they want too. Get them there fruity pebbles I have the munchies.  if weed was legal the fruity pebbles people would make a lot of money.  Life be good I have my bong I be smoking weed be good I have my bong somking.  The only people that I am voting for in Nov. is the people that are for legalizaton of weed and I do vote.  That is all for now my bong is telling me it’s time to somke smok it.
