Smoking Marijuana In Your Front Yard Will Be Legal In Denver

denver colorado marijuana consumption private propertySmoking marijuana in Colorado is now legal after the 2012 Election. But where you can smoke marijuana has been debated ever since marijuana became legal in Colorado, especially in Denver. The Denver City Council was proposing that the odor from marijuana consumption would be illegal, even if it came from one’s own property.

That would have been a nightmare for recreational marijuana users and medical marijuana users alike. If such a rule had been passed, a person could have been smoking in the privacy of their own home behind locked doors and if someone could smell it, it would have resulted in penalties. That would have been a very subjective measurement, as some people can smell better than others, and some people tolerate certain smells more than others.

It looks like according to the new proposal in Denver, smoking marijuana on one’s own property is legal, even in the front yard. A person can also smoke marijuana on other people’s property, so long as they have permission. The general odor enforcement laws will still apply, but as I stated in an article yesterday, a fine for that hasn’t been handed out since 1994. To read more about that story, click here.

The private property consumption rules could change if public view consumption becomes a problem. Per the Denver Post:

“I am guessing problems of people smoking marijuana in their front yards will turn out to be no problem at all,” he said. “It could be an enormous problem. In which case, we will come back and fix it. I would hate to make this more convoluted and ambiguous in anticipation of a future reality that hasn’t occurred yet.”

We’ll think of it like alcohol. You can’t publicly drink because it alters your state of consciousness like weed

  3. this is so sad to hear this people can smoke cigars, cigarettes and pipe tabacco outside in there own yard but not marijuana so sad

  4. This script is being presented to create uncertainly in the fact the Government, Religions, Academia & Corporate America colluded for 75 years against Hemp Food. If they just admitted they lied, we would shut the whole simulation down. Poof. Hemp would be currency. No need for money. No Gold standard. No Federal Reserve. That is what free Hemp means to Humanity. So accepting less, evidences ones ignorance, AND fear of change. As much as many would like to get high, they won’t give up their racial, class position in Society in exchange for unlimited potential of the other inhabitants. In evidence of this lack of fitness, I fear them. Their, or my fitness.

  5. The message is: If you don’t like the smell of marijuana, there are 48 other states you can live in. Seems fair considering for 75 years the people who enjoy plants had 0 states to legally enjoy plants in. Equality sometimes can be a level-playing field bitch, and control freaks go bezerk if they can’t perceive their dominance.

  6. I heard Pueblo passed recreational pot? Wonder how long it will take till its operational. I’ve been out of the loop for awhile!

  7. Jetta. I’m a long term resident of Colorado and a medical marijuana patent. Pot is legal in Colorado. But the city itself of springs passed a law so no shop’s for recreational sales can be built or sell there.. yes can smoke but won’t be able to purchase it for recreational use unless you buy it in Denver.

  8. I’m just confused I guess since I’m new to the state. You can smoke in your own home. But it’s not legal yet here in the Springs for retail sale. Sooo then where do you get it legally? Uhhh. I’m confused.
